Maryland Arrest Warrant Facts
When searching arrest records, outstanding warrants, or criminal records in Maryland you should know that Maryland is a closed state as far as records go. The law of Maryland allows for the dissemination of criminal records to agencies authorized to do so. The CJIS Central Repository is responsible for managing this task. Agencies that are covered under the CJIS are government agencies, employment entities, and criminal justice agencies at the state and federal level. These entities include adult dependent care, attorney/client, criminal justice agencies, child care and government employment agencies. Also, Maryland state government licenses such as taxicabs, racing commission, liquor boards and Maryland state police licenses including gun licenses, private detectives, special police agencies, and public housing fall under this category.

Searching Maryland Arrest and Criminal Records
The place to search for criminal records in Maryland is the Maryland Department of Public Safety and Correctional Services. This agency holds criminal history data for the entire state. A special division was created within the department to gather, store and disseminate criminal public data for both criminal and non-criminal purposes. This division is known as the Information Technology and Communications Division (ITCD). The ITCD works as a liaison between the Department of Public Safety and agencies that are seeking criminal history records. This division serves it's function with two programs: the Criminal Justice Information System (CJIS) and the Public Safety Data Center.

The Criminal Justice Information System (CJIS) is responsible for fingerprint-supported criminal identification, criminal history record information, and related functions such as expungement of records. The CJIS acts as the central archive for Maryland crime related data including information on active warrants, arrest records and more.

Any individual living in the state of Maryland may obtain a copy of their criminal background report provided they follow state guidelines. A necessary component of obtaining a copy of your criminal record is fingerprinting. The state will not release any records unless a set of fingerprints is submitted with each request. The Department of Public Safety and Correctional Services offers a list of state approved organizations to get fingerprints done.

Most of the time the agency that processed your fingerprints will send them directly to the Criminal Justice Information Service (CJIS) Central Repository on your behalf. If not you can overnight them yourself to 6776 Reisterstown Road, Suite 102, Baltimore Maryland 21215. You can also mail your fingerprints and request for records to CJIS-CR P.O. Box 32708, Pikesville, Maryland, 21282-2708. There is no fee for a criminal background check, but there is a fee to get fingerprinted. Individual criminal records will contain all arrest records whether there was a conviction or not. You can also request just a personal background report. A Maryland personal background report will cost you $18. If you need a copy with a gold seal it will cost you a dollar more at $19.



Maryland Sex Offender Records
The ITDC is also responsible for maintaining the state's sex offender registry. On their site you will be able to search registered sex offenders living and working near you and be notified of a registrants' change in status. In addition there are resources to help you learn how to prevent a sexual attack and to get help if you've been a victim of sexual abuse. A good tool for all citizens seeking sex offender information is the Maryland SOR tool. It allows you to type in an address and search for sexual offenders up to 5 miles away. The state also provides the Sex offender Registry Listing. You will have access to such information as the registrant's name, status, address of the last known residence on file, type of offense, a description of the crime, what they were charged with, and any other relevant information. If the offender lives in another state, the last reported place of employment or school they were associated with while in Maryland will be listed. Please note that the accuracy of the information on their site is dependent upon information provided by the registrants themselves.

Maryland Public Information Act
Maryland's Public Information Act (PIA) gives citizens the right to access government records which are available for disclosure by the state and to allow citizens the right to obtain copies of those records. The act does not provide access to all records, however. The reason for this is to protect government interests and citizen's privacy. For that reason only certain public records are included, with most court records being readily available to the public. You can view or request access to court records by contacting the local clerk’s office at the courthouse where the case was filed or the hearing was held. The Maryland court's website offers a directory for all appellate, circuit, district and orphan courts in the state if you need to track down a clerk or courthouse.



Finding an Inmate in Maryland
If you want to search for a person incarcerated in the state of Maryland, the Inmate Locator allows you to search the location of inmates in custody at the Commissioner of Correction, the Division of Correction Facilities, Patuxent Institution and the Division of Pretrial and Detention Services facilities. Please note that the search tool does not include every person in custody within the state. Inmates serving a short-term sentence, those who have been released, and those no longer in custody for another reason may not show up in the locator's database.


Maryland Expungement Process
As with other states, Maryland allows you to expunge certain criminal records. If you were charged with a crime and feel there is good reason to have the record removed, you may file a petition for expungement. To get a record expunged means you want the record removed from your personal file and sealed from public view. The process for expunction in Maryland may take up to 90 days to be completed. If there is an objection to the expungement or appeal to the request it could take longer. All the facts need to be considered by a judge before the case is decided whether or not to grant the expungement.

The fee to file for an expungment in Maryland is $30. It's advised to hire a lawyer so you can be sure the record was expunged successfully and your name is clear of the charge. Circumstances that allow for an expungement are;
You were found not guilty
The charge was dismissed
The charge resulted in probation before judgment
The State's Attorney did not prosecute
Your case was indefinitely postponed by the court
Your case was compromised or settled
You were convicted of only one non-violent criminal act and you were granted a full and unconditional pardon by the Governor.

In order to have your expungemnt considered by the state of Maryland, you must follow these guidelines. The first step is to obtain a petition for expungement (Form DC/CR 72) and the General Wavier and Release (Form DC/CR 78). You can pick one up at any district or circuit court location in Maryland. You can also download the forms from the Maryland judiciary site if you desire to do so. Fill out the form as accurately and clearly as possible before submitting them with your check to the court clerk where your case was concluded.

There is a different process to follow in cases where you were released but not charged and did not have to appear in court. You must contact the arresting agency where the arrest occurred and request the appropriate form(s) to have the charge removed from your criminal history record.
